Gavel on a book Stamford Divorce AttorneyOur Stamford divorce attorney may be able to help you with a restraining order. Also called a personal protection order by some courts, a restraining order may protect you if you feel physically threatened by another person or have been the victim of domestic violence. A restraining order is a type of court order that is aimed at preventing the person threatening or abusing you from continuing to threaten and contact you. In most cases, a restraining order also requires the person to keep a certain distance from you.

How to Get a Restraining Order

You will need to visit a courthouse and apply for a restraining order to get one. This paperwork is often called an application or petition. In your petition for a restraining order, you will need to explain to the judge why you believe you need the court to protect you. You should be as specific as you can, and if you have police reports or other documents proving that you have been abused or threatened, you should bring these documents with you. If the judge is satisfied by your petition, the judge will then either sign your restraining order on that day or choose to hold a hearing where you can verbally explain your request. After this, if the restraining order is granted, you will need to arrange for copies of the restraining order to be sent to the person who is threatening or abusing you. Your local sheriff or court can explain how to best do this, as can your Stamford divorce attorney.

Handling a Restraining Order

Keep your copy of the restraining order with you at all times. If the person abusing or threatening you attempts to contact you again or shows up, you should immediately call the police. Do not try to handle the situation on your own. For the process to work, you have to follow through by contacting the police if you feel the person has violated the restraining order. Above all else, be cautious and be safe.
